MOTIVE? Discovery is Often What is Not There.

In a review of the Town of San Anselmo Ordinance Listing, I discovered that legal documents (Town Ordinances)approved after the 1952 flood were missing.

The files where the documents should have been located were out of sequence and looked as though a quick removal had taken place.

Are the missing pages of onionskin paper the result of a deliberate purging or incidental disorganization that would only benefit the Town's position in their defense against the Billion Dollar Flood Lawsuit?

I let Town Staff know that the documents are missing and that I will return on Thursday morning to see if the Ordinance files are intact and missing documents have reappeared. At that time I will photocopy them so there will be no more inadvertant opportunities taken by government officials to rewrite a disquieting history of their own making.

Administrative Assistant Kessel returned with the San Anselmo Town Ordinance files.

" These were ones that were in Debbie's ( Town Manager Stutsman) office. These ones right here are the ones dated from 1953-1960. I guess apparently some were missing and Debbie was saying that we don't have any control the ones of there are any missing. We can go to the Minutes if you find that there is one missing."

Louise Mathews responded, "So she (Town Manager Debra Stutsman) is not concerned that State law requires that the Town maintain its Resolutions?"

The same Resolutions that were missing on Monday are still missing on Thursday.

Resolution 739 was in file.

Proclaiming a State of Emergency and Declaring the City of San Anselmo to be a Disaster Area.

"That due to unprecedented heavy and continuous rains a certain area of the City of San Anselmo abutting on Forest Avenue of said City has been effectively cut off due to a collapse and subsidence of a large portion of Forest Avenue that it is impossible to furnish a large number of inhabitants with fire or police protection or to gain access for emergency purposes such as medical attention; that several homes of the homes abutting on said street are in danger of sliding off the hillside into the creek below; that if such homes do in fact slide into said creek will become effectively obstructed and cause untold damage and hardship; that it is necessary to forewith repair or bridge that portion of Forest Avenue which has collapsed so as to afford access to and communication with the homes and inhabitants who have been cut off from the City; that the tools, machinery, manpower, equipment, and facilities and finance of the City of San Anselmo are inadequate to cope with the situation or to provide for the health, safety and welfare of the inhabitants effected by the disaster;

Resolution approved by Town Council April 4, 1958

If San Anselmo Town Manager Debra Stutsman continues the management of official government documents in a carnival atmophere , I will save hundreds of dollars a year because there will be no public records left to research and photocopy.

Hmmm..... misfiled documents.... I had the same problem with some building dept related minutes.

Hope misfiling the building dept minutes is not repeated when the Muller Development ( part of REX/COUTURE SA Vision) is considered.

Oh, I forgot. The proposed lot merger of the three parcels at the corner of Belle and San Anselmo Ave owned by Muller is not expected to be a public hearing according to Planning Director Lisa Wight/.

Maybe misfiling paperwork is not worst that can occur.
